ClerkBid User Agreement

Welcome to ClerkBid, a free tool provided by AuctionMethod. By accessing or using ClerkBid, you agree to the terms below. If you do not agree, do not use the tool.

1. Use of the Tool

ClerkBid is provided for general informational and operational purposes related to auctions and bidding activities. You are responsible for how you use the tool and for any outcomes that result from your use.

ClerkBid is not a system of record. You should not rely on it as your official auction ledger or sole source of truth.

2. No Guarantees

ClerkBid is provided "as is" and "as available," with all faults. To the fullest extent allowed by law, AuctionMethod disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

  • The tool will be error-free or uninterrupted
  • The results produced will be accurate or complete
  • The tool will meet your specific needs

3. Assumption of Risk

You use ClerkBid at your own risk. You are solely responsible for any decisions, actions, or transactions that rely on the tool.

This includes, but is not limited to:

  • Bidding decisions
  • Financial outcomes
  • Data entry or interpretation errors

4. Limitation of Liability

To the fullest extent allowed by law, AuctionMethod and its affiliates, officers, employees, and partners will not be liable for any damages arising from your use of ClerkBid. This includes direct, indirect, incidental, consequential, special, or punitive damages, even if we were advised such damages were possible.

If liability cannot be fully disclaimed, it will be limited to the greater of $100 or the amount you paid to use ClerkBid (which is currently $0).

5. Indemnification

You agree to defend, indemnify, and hold harmless AuctionMethod and its affiliates, officers, employees, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

  • Your use of ClerkBid
  • Your data or content
  • Your violation of these terms
  • Any transaction or dispute between you and any third party

6. No Professional Advice

ClerkBid does not provide legal, financial, or auctioneering advice. You should consult qualified professionals before making decisions that carry risk.

7. Changes to the Tool

We may modify, suspend, or discontinue ClerkBid at any time, with or without notice.

8. Changes to These Terms

We may update these terms from time to time. Continued use of ClerkBid means you accept any changes.

9. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles.
